Criteria for Recognition of a New Political Party by the Election Commission

In order for the Election Commission to consider an application of a political party for recognition, an organisation must prove it has engaged in recognised political activity continuously for the last four years.

 

The Election Commission calls for applications for new political parties only during the month of January.

 

It is not mandatory that an organisation should engage in political activity in the last four years under the same name it eventually registers as a political party. For example, an organisation founded under the name XYZ - while engaged in political activity has the option of changing its name to ABC via a constituent assembly. The due legal process of the name change from XYZ to ABC must be followed and be proven to the Election Commission.

 

However, if a particular organisation is formed by the combination of two organisations; i.e. If two organisations XYZ and PQR merge to form an organisation ABC, then ABC is formally recognised as a brand-new organisation. Therefore, past political activity of neither XYZ nor PQR are deemed valid when considering the registration of ABC as a recognised political party.

 

One way around this technicality is for the members of PQR to join XYZ, and then change the name of XYZ to ABC as mentioned above.

 

However, the validity of whether the activity engaged in by a given organisation in the last four years is truly of political nature, will be at the discretion of the current Election Commission.

මැතිවරණ කොමිෂන් සභාව විසින් පිළිගත් දේශපාලන පක්ෂයක් ලෙස නම් කිරීමට ප්‍රථම, එම සංවිධානය පසුගිය වසර හතර තුල පිළිගත් ආකාරයක දේශපාලන කටයුතු වල නිරත වී තිබෙන බව සනාථ කළ යුතුයි.

 

 නව දේශපාලන පක්ෂ සඳහා මැතිවරණ කොමිෂන් සභාව විසින් අයදුම්පත් කැඳවන්නේ ජනවාරි මාසය තුල පමණයි.

 

යම් සංවිධානයක් පසුගිය වසර හතර තුල නිරත වුනු දේශපාලන ක්‍රියාකාරකම් ඔවුන් අවසානයේ ලියාපදිංචි වන දේශපාලන පක්ෂයේ නමින්ම කළ යුතුය යන්න අනිවාර්ය නැහැ. උ.දා. XYZ නමින් ආරම්භ කරන ලද සංවිධානයක් එම ක්‍රියාකාරකම් වල නිතර වන අතරම, ව්‍යස්ථාපිත රැස්වීමක් හරහා ඔවුන්ට සංවිධානයේ නම ABC ලෙස වෙනස් කිරීමේ හැකියාව පවතිනවා. XYZ යන සංවිධානයේ නම ABC ලෙසට නීත්‍යානුකූලව වෙනස් වූ ආකාරය පැහැදිලිව පෙන්වා දිය යුතුයි.

 

නමුත් සංවිධාන දෙකක එකතුවෙන් එක් සංවිධානයක් පිහිටුවනවා නම්; උ.දා. XYZ සහ PQR යන සංවිධාන දෙකක එකතුකින් නම් ABC යන සංවිධානය හැදෙන්නේ, එවිට ABC පිළිගැනෙන්නේ නව සංවිධානයක් ලෙසයි. එනිසා XYZ සහ PQR යන සංවිධාන වල අතීත දේශපාලන ක්‍රියාකාරකම් තව දුරටත් ABC පිළිගත් දේශපාලන පක්ෂයක් ලෙස ලියාපදිංචි කිරීමේදී වලංගු නොවෙයි. 

 

මෙය මගහරවා ගැනීමට හැකි එක් ආකාරයක් වන්නේ, එසේ නම් PQRහි සාමාජිකයන් XYZ යන සංවිධානයට බැඳී, XYZ සංවිධානයේ නම ඉහත කී ආකාරයට ABC ලෙස වෙනස් කළ යුතුයි. 

 

ඒ කෙසේ නමුත්, කිසියම් සංවිධානයක් පසුගිය වසර හතර තුල නිරත වූ ක්‍රියාකාරකම් නියත වශයෙන් දේශපාලන ක්‍රියාකාරකම් ද සහ එහි වලංගුතාවය පිළිබඳ තීරණය ගනු ලබන්නේ වර්තමාන මැතිවරණ කොමිෂන් සභාව විසිනි.
